Item Competition Law and Protection of Trade Names and Trademarks in Ethiopia: A Case Study(Addis Ababa University, 2017-02) Yaebeyo, Gebreamlak; Haile, BirukThi thesis examines the adequacy and compatibility of the legal frameworks goveming trademarks. trade names and trade competition in Ethiopia. To this end. it employs tools of legal review and ca e analysi ' buttressed by qualitative data obtained from interviews, countly experiences and ca 'e tudy. The thesis principally, scrutinizes the Trademark Registration and Protection Proclamation No.50 112006 that lacks a clear legislative stipulation for the recognition of earlier tradenalnes upon trademark registration. Although the law requires distinctiveness for the registrability of trademarks, the writer contend' that thi cat/not adequately resolve priority conflicts between trade names and trademarks. There is no well-developed j udicial jurisprudence rectifying the legislative loophole either. Furthermore, the regi tration of trademarks and trade names in different organs poses practical problems. A deadlock arises sinc ' the Ministry of Trade and the Ethiopian [ntellectual Property Office have no mutually supportive 'earch data ba 'es dwing registration. [n particular, the registration of a trademark in respect of class of ervice or goods which conflIcts with a trade name of a business entity regi tered with similar activities to the good or ervices, and vice ,,"rsa provokes avalanche of tradename-trademark infringements and unfair competition uits. The thesi also finds out significant lacunae on the competition, trade name, and trademark regimes which become stumbling blocks for succes ;fit! enforcement actions out there. So much so that, the present thesis propo es the articulation of priority and prevalence rules during the registration oftradenames and trademarks supplemented by institutiOllal synchronization across trademarks. trade names and competition regime . The legislature should adopt an eclectic line ofjurisprudencejrom the benchmarked countly experiences discussed in the paper. This exercise requires legislative amendment and institutional revitalization.Item Investigation into Some of The Engineering Properties of Soils Found in Woliso Town(Addis Ababa University, 2014-12) Haile, Biruk; Tadesse, Samuel (PhD)Investigation of the ground conditions is used for the economical design of the sub structural elements. It is also necessary to obtain sufficient information on type, characteristics and distributions of soil and rock underlying a site for proposed structures. The overall aim of this study is to come up with reliable results for some of the engineering properties of soils found in Woliso town in order to understand clearly the nature of the soil so that suitable foundation can be recommended for better design and construction of civil engineering structures in the town. To achieve these objective disturbed and undisturbed samples from different parts of the town were collected and laboratory tests were done on the collected samples. The undisturbed samples were taken from the test pits by mechanically driving a Shelby tube. For all tests the apparatus and the procedures used for analysis were done according to American Society for Testing Materials (ASTM) standard. The natural moisture content of soil in the study area ranges from 25.5% - 66%. Expansive and non-expansive soils were investigated in the study area. The average specific gravity of the expansive soils is 2.68 and a non-expansive soil is 2.74. The grain size analysis test result showed that the dominant proportion of soil particle in the research area is clay. For expansive soils the clay content ranging from 55 - 80%, silt ranging from 13.8 – 28.2%, sand ranging from 4.5 – 9.7% and gravel ranging from 0.1 – 11.4% and for non-expansive soils the clay content ranging from 42.5 – 85%, silt ranging from 12.8 – 51.1%, sand ranging from 2.2 – 7.5% and gravel ranging from 0 – 0.4% . Atterberg Limit test results in the research area showed a liquid limit of expansive soils ranging from 70.5 - 126%, plastic limit ranging from 31.2 - 44% and plasticity index ranging from 39.3 – 81.7% and for non-expansive soils the liquid limit ranging from 56.2 – 61.1%, plastic limit from 30.3 – 34.4% and plasticity index ranging from 26.2 – 29.7%. According to Unified Soil Classification System, expansive and non-expansive soils in the study area are categorized as highly plastic inorganic clay and silt soils respectively. The unconfined compressive strength of the soils in the study area ranges from 75 -540kN/m2 and undrained shear strength ranges from 37.5 - 270 kN/m2. Unconfined compressive strengths show that the approximate consistencies of the soil ranges from medium to hard. One-dimensional consolidation test showed that the area under investigation is over consolidated in its natural state, have compression index ranging from 0.11-0.62, coefficient of consolidation from 1.25-17.17 (x10-3)cm2/min, coefficient of permeability from 0.15-10.63 (x10-8 cm/sec).Item The practice and challenges in conducting action research: the case of sululta secondary school(Addis Ababa Universty, 2003-06) Haile, Biruk; Nega, Mulu(PhD)The main purpose of this study was to investigate the practices and challenges of conducting action research in Sululta Secondary School and identify the major factors that hinder/enable teachers in conducting action research. The research method employed in this study was mixed method approaches (QUAN + qual), which is embedded in concurrent type of mixed method. Both primary and secondary sources of data were used. The primary data sources were teachers, principals and town administration education officers. The school documents were used as a secondary data source. The questionnaires were pilot tested and administered to 15 teachers. About 97% of the questionnaires were properly filled and returned. In addition to this, interview, focus group discussion and document analysis were made to collect the necessary information. Results obtained were analyzed by using descriptive statistics and narratives. The results of the study revealed that a) the practices of Sululta Secondary School teachers in conducting action research were very low, b) the knowledge and skills of teachers in the study area were sufficient but their involvement in undertaking action research were insufficient, c) the role of school management in encouraging teachers to conduct action research were insufficient, d) the major factors that hinder teachers to conduct action research in the study area are shortages of training, seminars and workshops regarding research activities, insufficient budget, insufficient reference materials and library services and etc. e) the major factors that enable some teachers to conduct action research were their professional commitment to support their teaching learning process with research.
